Marryfix Terms of Use

California subscribers: You may cancel your subscription, without any penalty or obligation, at any time before midnight of the third business day following the date you subscribed. If you subscribed using an External Service (e.g. Apple ID, Google Play), you must cancel your subscription through the External Service, as described in more detail in the relevant section. If you subscribed through your Apple ID, refunds are handled by Apple, not Marryfix.

All other users may request a refund by contacting Marryfix Customer Service at support@marryfix.com, or by mailing a signed and dated notice stating that you, as the buyer, are canceling this contract, or other words to that effect. Please also include the name, email address, phone number, and other unique identifying information you used when creating your account.

1. INTRODUCTION

When you access or use the Marryfix Services, you agree to be bound by this Terms of Use Agreement ("Terms" or "Agreement"), including our Privacy Policy, Cookie Policy, Community Guidelines, and Safety Tips, so it is important that you read this Agreement, these policies, and procedures before creating an account.

PLEASE CAREFULLY REVIEW THE DISPUTE RESOLUTION PROVISIONS IN SECTION 15 BELOW. ANY DISPUTES BETWEEN YOU AND MARRYFIX WILL BE RESOLVED IN THIS MANNER.

We may make changes to these Terms from time to time, so please check this page regularly for possible updates.

Welcome to Marryfix.

These Terms of Use are a contract between you and the following service provider. Marryfix is not a company — it is operated by an individual (natural person) developer:

If the individual developer begins operating in the future through a virtual office or a legal entity, this section will be updated under the same versioning rule.

The words "we," "our," "us," and/or "Marryfix" refer to the service provider above. You and the service provider may be referred to together as the "Parties," or individually as a "Party."

When you access or use our Services (together, the "Service" or "our Services") through the website, the Marryfix mobile application ("App"), or other platforms, or any other services that Marryfix may offer, you agree to be bound by this Agreement. This Agreement applies to everyone who accesses or uses our Services, regardless of registration or subscription status.

Your access to and use of our Services is also subject to the Privacy Policy, Cookie Policy, Community Guidelines, and Safety Tips, incorporated into this Agreement by reference, as well as any other terms disclosed to and accepted by you when purchasing additional features, products, or services from Marryfix ("Post-Purchase Additional Terms"). If you do not want to be bound by this Agreement, please do not access or use our Services.

2. ELIGIBILITY TO OPEN AN ACCOUNT; YOUR RESPONSIBILITIES

Before creating an account on Marryfix, make sure you are eligible to use our Services. This Section contains information about what you can and cannot do while using our Services, along with the rights you grant to Marryfix.

To create an account and use our Services, the following must be true, and by using our Services you represent and warrant that:

  1. You are an individual at least 18 years of age (i.e. not any legal entity, partnership, or other commercial enterprise);
  2. You have the legal capacity to enter into a binding contract with Marryfix;
  3. You are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country;
  4. You are not listed on any U.S. Government list of prohibited or restricted parties;
  5. You are not legally prohibited from using our Services;
  6. You have not been convicted of, or pled no contest to, a felony or indictable offense (or similarly serious crime), a sex crime, or a crime involving violence or the threat of violence, unless you have been pardoned for a non-violent crime and we have determined that you do not pose a threat to other users of our Services;
  7. You are not required to register as a sex offender with any government entity;
  8. You do not have more than one account on our Services; and
  9. You have not previously been removed from our Services by us, unless we have given you express written permission to create a new account.

If you cease to meet these requirements at any time, all authorization and permission to access our Services or systems is automatically revoked, and you must delete your account immediately. In such cases, we reserve the right to remove your access to our Services without notice.

In this context, you agree to:

  1. Comply with these Terms, and check this page from time to time to stay informed of changes;
  2. Comply with all applicable laws, including without limitation privacy laws, intellectual property laws, anti-spam laws, and regulatory requirements;
  3. Use the most recent version of the app;
  4. Review the Safety Tips;
  5. Review, and comply with, the Community Guidelines as updated from time to time; and
  6. Take reasonable measures to keep your login credentials confidential.

Registration information — first and last name: During registration, first name and last name information is collected in separate form fields. Information you enter in the last name field is not shown to other users in the app interface. The first name field may be displayed on your profile; you should only enter your first name in this field. If you voluntarily enter your last name or full name into the first name field, that information may be visible to other members; in that case, responsibility for the content you entered rests with you, provided Marryfix does not disclose the last name field. You also agree that you will not:

  1. Misrepresent your identity, age, or affiliation with any person or entity;
  2. Use the Services in a way that could damage the Services or that could prevent other users from using them;
  3. Use our Services in a manner that could impede, disrupt, or negatively affect our platform, servers, or networks;
  4. Use our Services for harmful, illegal, or malicious purposes, including but not limited to the use of virtual items for money laundering or other financial crimes;
  5. Harass, bully, stalk, threaten, defame, defraud, harm, or otherwise abuse or cause psychological harm to any person;
  6. Post or share any Prohibited Content (as defined below);
  7. Solicit passwords from other users for any purpose, or solicit personal identifying information for commercial or unlawful purposes, or disseminate another person's personal information without their consent;
  8. Solicit money or anything else of value from another user, whether as a gift, loan, or other consideration;
  9. Use another user's account;
  10. Use our Services in connection with fraud, pyramid schemes, or other similar practices;
  11. Use our Services in connection with the financing of any political campaign, or to influence any election, other than sharing your own personal political views;
  12. Violate the terms of any license granted to you by Marryfix;
  13. Disclose private or proprietary information that you have no right to disclose;
  14. Copy, modify, transmit, distribute, or create derivative works of any Member Content or Our Content, or any copyrighted material, images, trademarks, trade names, service marks, or other intellectual property, content, or proprietary information accessible through our Services;
  15. State or imply that any statement you make is endorsed by Marryfix;
  16. Use any robot, spider, site search/retrieval application, or other manual or automated device, method, or process to access, retrieve, index, "data mine," or in any way reproduce or circumvent the navigational structure or presentation of our Services or their content;
  17. Upload viruses or other malicious code, or otherwise compromise the security of our Services;
  18. "Frame" or "mirror" any part of our Services without our prior written authorization;
  19. Use the Marryfix application programming interface (API) without our written approval; or
  20. Create a new account without our express permission if your account has been suspended or terminated by us.

Prohibited Content — Marryfix prohibits the uploading or sharing of the following types of content:

  1. Content that is reasonably considered offensive, or that harasses, abuses, or causes psychological distress to another person;
  2. Obscene, pornographic, violent, or nudity-containing content;
  3. Abusive, threatening, discriminatory content, or content that promotes or supports racism, sexism, hatred, or bigotry;
  4. Content that promotes or facilitates illegal activity, including terrorism;
  5. Content that promotes self-harm, eating disorders, dangerous challenges, and similar behavior;
  6. Defamatory, degrading, or false content;
  7. Content related to commercial activity (sales, competitions, promotion and advertising, services, sex work, etc.);
  8. Content that constitutes or facilitates the sending of unsolicited email;
  9. Content containing malicious code, viruses, or spyware;
  10. Content that infringes the rights of any third party;
  11. Content containing another person's image or likeness without their permission;
  12. Content containing the image or likeness of a minor.

3. CONTENT

While using our Services, you will have access to (i) content you upload ("Your Content"); (ii) content uploaded by other users ("Member Content"); and (iii) content provided by Marryfix ("Our Content").

3a. YOUR CONTENT

You are responsible for Your Content. Do not share anything that you don't want others to see, that would violate this Agreement, or that could create legal liability for you or us. You agree to indemnify, defend, and hold us harmless against claims and lawsuits arising in connection with Your Content.

When you upload Your Content, you represent that you have all necessary rights and licenses to upload that content. You agree that we may review, remove, or restrict access to that content.

3b. MEMBER CONTENT

Member Content belongs to the user who shared it. You should always carefully review and independently verify Member Content for accuracy. You have no rights with respect to Member Content and, unless expressly permitted by Marryfix, you may only use Member Content for the purposes of our Services. You may not copy or use Member Content for commercial purposes.

3c. OUR CONTENT

Marryfix owns or licenses all other content (text, graphics, logos, etc.) available on our Services. All rights and ownership in Our Content shall remain with us at all times.

4. INAPPROPRIATE CONTENT AND MISUSE; REPORTING

Inappropriate content or inappropriate behavior will not be tolerated on our Services. We recommend you report inappropriate Member Content or behavior. If we determine you have violated these Terms, we may suspend or terminate your account.

5. PRIVACY

Privacy is important to us. You can read our Privacy Policy for more information about how Marryfix collects and uses your personal data. By using our Services, you agree that we may share your personal data in accordance with our Privacy Policy.

6. RIGHTS MARRYFIX GRANTS YOU

As long as you comply with these Terms, Marryfix grants you a personal, worldwide, royalty-free, non-transferable, non-exclusive, revocable license to access and use our Services.

7. RIGHTS YOU GRANT MARRYFIX

You grant Marryfix a worldwide, perpetual, transferable, sublicensable, royalty-free right and license to host, store, use, copy, display, reproduce, adapt, edit, publish, translate, and distribute Your Content.

In addition, you grant Marryfix the authority to act on your behalf against any infringement of Your Content taken from within our Services by other users or third parties, so as to prevent its use outside our Services.

8. PURCHASES AND AUTOMATICALLY RENEWING SUBSCRIPTIONS

You may purchase products and services offered within the app. For the legal pre-information (identity of the seller, essential characteristics of the service, total price, right of withdrawal) provided to you before you agree to a paid subscription, see the Distance Service Pre-Information Form.

8a. EXTERNAL SERVICE PURCHASES AND SUBSCRIPTIONS

If your External Service Purchase (Apple App Store, Google Play Store, etc.) has an automatically renewing subscription, your External Service Account will continue to be charged periodically for the subscription until you cancel. To manage or cancel your subscription, you must go to your External Service Account settings.

8b. IN-APP PURCHASES AND SUBSCRIPTIONS

When you make an in-app purchase, you authorize us to charge your payment method. For automatically renewing subscriptions, you will be charged periodically until you cancel.

8c. VIRTUAL ITEMS

Virtual items are non-refundable, and ownership does not transfer to you — only a limited license to use them is granted.

8d. REFUNDS

In general, all purchases are final and non-refundable. However, if you have a right of withdrawal under the laws of your country, you may exercise that right within the applicable time limits. Refund requests for purchases made through Apple should be directed to Apple.

9. TERMINATION OF ACCOUNT

You may delete your account at any time. However, you may need to separately cancel any subscriptions made through your External Service Account. Marryfix reserves the right to terminate your account if we determine that you have violated these Terms.

10. IDENTITY VERIFICATION AND CRIMINAL RECORDS

Marryfix does not perform criminal record checks on users. However, to enhance platform security, we offer a facial liveness detection and selfie-based identity verification process. This verification is intended to confirm that an account belongs to a real person; it does not provide a full and absolute guarantee of a user's identity, background, or intentions.

You may decline to participate in the verification process; however, in that case your access to the verified profile badge or certain features requiring verification may be limited. You are solely responsible for your interactions with other users.

11. DISCLAIMER

OUR SERVICES ARE PROVIDED "AS IS." MARRYFIX MAKES NO WARRANTY THAT THE SERVICES WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

12. DIGITAL MILLENNIUM COPYRIGHT ACT (DMCA)

We take copyright infringement seriously. You can send copyright infringement notices to support@marryfix.com.

13. ADVERTISEMENTS AND THIRD-PARTY CONTENT

Our Services may contain advertisements and links provided by third parties. Marryfix is not responsible for such content.

14. LIMITATION OF LIABILITY

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, MARRYFIX SHALL NOT BE LIABLE UNDER ANY CIRCUMSTANCES FOR ANY INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES.

15. DISPUTE RESOLUTION

If you have any issue, we recommend you first contact Customer Service.

15a. INFORMAL DISPUTE RESOLUTION PROCESS

If you have a dispute with Marryfix, you agree to send us a written notice before pursuing litigation.

15b. ARBITRATION AND CLASS ACTION WAIVER

To the extent permitted by law, you agree that disputes will be resolved through binding arbitration and that you waive your right to participate in class actions.

16. GOVERNING LAW

This Agreement is governed by the laws of Türkiye, without regard to conflict-of-laws principles.

17. VENUE

Unless otherwise required by law, any litigation arising from this Agreement will be conducted exclusively in the courts of Central İstanbul.

18. INDEMNIFICATION

You agree to indemnify Marryfix in the event any claim or demand is brought against Marryfix due to your actions.

19. ENTIRE AGREEMENT

These Terms constitute the entire agreement between you and Marryfix regarding the use of our Services.
